Do I need to file probate?
We will help you determine if you need to file and what type of filing may be necessary.
Examples of Probate Assets
- House in the deceased’s name.
- Bank account with no other account holder and no beneficiary named.
- Life Insurance Policy with no named beneficiary.
- Investment Accounts with no named beneficiary.
- Examples of Non-Probate Assets:
Bank Account with Pay-On-Death beneficiary listed. - House with another owner, owned as joint tenants with rights of survivorship (important), or husband and wife.
- Investment accounts with a named beneficiary.
- Any assets owned in trust. *Assets not properly funded into the trust may still have to be probated.
